My Vote goes for Form 17A; Section 49-O


In my earlier post, I’ve said that I am not going to vote for any party in these MCD Elections 2012. The soul reason is incapability of candidates. Though, there are ‘n’ number of candidates contesting elections from different parties but only two parties; Congress and BJP are in real battle ground. In my ward (Ward 9) both the candidate are known to nobody in the area. I don’t even know if any of those candidate ever graduated from college.

All I know is the the candidate from Congress is wife of personal-assistant of Mr Bitto; acting MLA of our constituency. Well, we know how she would have been able to land a ticket from Congress. Almost same goes for BJP.
Looking at above thing, I’ve decided to Vote-but-not-vote. I’ve decided that I will exercise my right to reject. I will go the pooling booth and ask for Form 17 A and under rule 49-O vote-a null vote.
Enclosed is a full procedure of how to exercise said right:
Text of Rule 49-O
According to the Rule 49-O in the Conduct of Elections, 1961, of India –
49-O. Elector deciding not to vote.- If an elector, after his electoral roll number has been duly entered in the register of voters in Form-17A and has put his signature or thumb impression thereon as required under sub-rule (1) of rule 49L, decided not to record his vote, a remark to this effect shall be made against the said entry in Form 17A by the presiding officer and the signature or thumb impression of the elector shall be obtained against such remark.
How to register a NULL VOTE?
Presently, as the EVMs don’t have any option to select NO candidate, to register a NULL VOTE, one needs to register his details at the polling booth, and then inform the presiding officer that he wishes to vote for nobody, or register a NULL VOTE, or vote against all candidates. In case of paper ballot, one can just stamp the names of multiple candidates or not stamp at all, to waste his vote.

  1. When the system itself is defective, what a good candidate will do. The proof to the system being defective is that you elect your representative and that is hijacked by the party in the name of whip. Political parties are corrupt as they are devoid of any intra party democracy, secretive fund holding and insensitive system of chosing candidates. Hence this system needs to be uprooted.

    In such case 49-O is the best route to do that. Not just cast refusal or null vote, but write a remark the “I REJECT ALL” and you are entitled to do that. In case we get highest such votes polled in a constituency, then spreme court can be approached for its interpretation and we have reason to be hopeful that it will be rational…………… L D Kala

    • Many thanks for your comment and making such a strong opinion. I appreciate your ideas and also stand by them.

      I wish the day comes soon when there are more reject votes than favour-votes. It is high time we tell these parties tat we need good candidates along with political parties with atleast some moral ideas.
